Legality
If you reside in Philadelphia and are registered with the state’s medical marijuana program, then cannabis can be utilized for therapeutic purposes. It has proven beneficial for patients suffering from serious conditions like ALS, autism, multiple sclerosis, and pain.
When searching for a dispensary in King of Prussia, Pennsylvania, make sure it complies with all medical marijuana program regulations. That means having legally compliant computerized and bar-coded labels on each product as well as maintaining accurate records for each patient within their system.
Keystone Shops opened its first dispensary in Devon, PA in February and are planning a third location near King of Prussia, PA. Recently they were acquired by Trulieve Cannabis – a national retailer with operations across ten states.
Recreational Cannabis Regulations
Recreational cannabis regulations have been in place in the US for some time. At present, 21 states (plus two territories) and D.C. regulate non-medical sales of cannabis.
New York’s recreational cannabis regulations are quite complex and take some time to get underway. Cuomo passed the Marijuana Regulation and Taxation Act in 2021, creating the Office of Cannabis Management (OCM) with responsibility for enforcing these weed laws.
The OCM received over 900 applications for Conditional Adult-Use Retail Dispensary (CAURD) licenses and plans to grant 150 initial licenses.
It takes a social justice-oriented approach to the process. Applicants must be “justice-involved,” meaning they have either received a criminal conviction or been on probation for marijuana-related offenses.
This has had the unfortunate result of shutting out many legacy market operators. These individuals have been in business for years and made substantial profits doing it.
Taxes
The cannabis industry is on the rise, as are the taxes and fees associated with it. Whether you’re a business owner, cultivator, or manufacturer in Pennsylvania, understanding how the tax system functions is essential.
For example, dispensaries must pay a 5 percent medical marijuana gross receipts tax on their taxable sales. This same 5 percent tax must also be paid by growers or processors when selling their product to a dispensary.
Taxes on marijuana products such as flowers and edibles are essential for both growers and dispensaries alike since they generate revenue for the state that goes towards funding schools. It’s wise to consult your budtender about how much tax you must pay and how to report it correctly.
On the cannabis excise tax page, you can find a comprehensive list of current tax rates and markups. It also has information regarding registration, filing, and account maintenance. Furthermore, videos provide essential guidance for retailers, distributors, cultivators, and manufacturers.
