Hemp Products in Illinois, Nevada, South Carolina, Pennsylvania, And Kentucky

Currently, many states have been legalizing the cultivation of hemp. Among them are Illinois, Nevada, South Carolina, Pennsylvania, and Kentucky.

Illinois

Buying hemp-derived delta-8 products in Illinois is legal, although the product is not yet fully legalized. Delta-8 is a cannabinoid that is extracted from hemp plants but is not classified as marijuana. This is because hemp-derived delta-8 is not a controlled substance under state law.

Illinois passed an Industrial Hemp Act before the Farm Bill was passed in 2018. The Farm Bill legalized hemp products, including delta-8 products. Illinois passed an interim rule defining legal hemp production. The rule allows for the cultivation of industrial hemp and the sale of hemp-derived delta-8 products under the agricultural hemp program.

The Illinois legislature enacted temporary hemp rules in early 2019. The law defines legal hemp as the Cannabis sativa L., and limits the content of tetrahydrocannabinol (THC) in edible hemp products to five milligrams per serving.

Kentucky

During the legislative session of 2013, Kentucky passed House Bill 197, which aligned Kentucky hemp laws with federal law. This law also defined hemp as a cannabis plant that contains no more than 0.3% THC on a dry weight basis. The bill included a controversial provision. This law stated that hemp extract materials must be remediated before they can be shipped to Kentucky.

Kentucky lawmakers have also attempted to legalize medical marijuana, which was not successful. A bill was introduced in January 2022, which would have made medical marijuana legal in Kentucky. However, the bill failed to make it to a committee.

Kentucky is one of the largest hemp-growing states in the United States. The state has a well-organized hemp program. It has a Hemp Advisory Board which provides input to the Kentucky Department of Agriculture.

Indiana

Among the states that haven’t legalized marijuana, Indiana has opted to make the hemp plant and its derivatives legal. But what are these products and how are they made?
