In its lawsuit, AK Futures claimed that Boyd Street was selling counterfeit versions of Cake-branded e-cigarettes, vapes, and other products. Boyd Street, however, denied the allegations and did not oppose AK Futures’ motion for a preliminary injunction. The district court ruled in favor of AK Futures and awarded a preliminary injunction.
The US Court of Appeals for the Ninth Circuit, which has jurisdiction over the case, affirmed the district court’s ruling. The court found that the Cake mark was valid. It also found that the confusion between the trademark and the copyright was harmless.
